International Developments – Updated June 2017
Laws adopted and in force

AUSTRALIA—

  • December 1, 2011Tobacco Plain Packaging Act adopted;
  • December 1, 2012 Tobacco Plain Packaging Regulations came into force. 1 Legislation applies to all tobacco products.
  • Legal challenges: High Court constitutional challenge by tobacco industry dismissed October 2012 2; Investment treaty claim by Philip Morris dismissed December 2015 3; World Trade Organization dispute panel ruling due by July 2017 4 (media reports are that the interim award is in Australia’s favor 5).

UNITED KINGDOM—

  • March 2015Standardised Packaging of Tobacco Products Regulations adopted;
  • May 20, 2016 Regulations came into force 6 (applies to England, Wales, Northern Ireland, and Scotland). Legislation applies to cigarettes and hand-roll-tobacco. Old stock could be sold until May 20, 2017. 7
  • Legal challenges: High Court challenge by tobacco industry dismissed May 2016 ; ruling upheld by Court of Appeal November 2016. 8

FRANCE—

  • November 24, 2015 Legislation providing powers adopted by the Assemblée Nationale (Law n°2016-41); March 22, 2016 Decree and Ministerial Order were published;
  • May 20, 2016 Decree came into force. 9 Legislation applies to cigarettes and hand-roll-tobacco. Old stock could be sold until January 1, 2017.
  • Legal challenges: TheConseilConstitutionnel upheld the law in a decision on January 21, 2016 10 ; the Conseild’État dismissed six industry challenges in a decision given on December 23, 2016. 11

 

Laws adopted but not yet implemented

HUNGARY—

  • August 16, 2016 Decree No. 239/2016 published. 12
  • August 19, 2016 All new brands/variants must be in plain packaging.
  • May 20, 2019All existing brands must be in plain packaging. Applies only to cigarettes and hand-roll-tobacco.

HUNGARY—

  • March 10, 2015 Public Health (Standardised Packaging of Tobacco) Act 13 adopted (commenced March 29, 2017);detailed regulations 14 are pending.The law comes into effect in September 2017. Applies to all tobacco products.
  • Legal challenge: Claim by Japan Tobacco International in the Commercial Court struck out November 2016. 15

GEORGIA—

  • May 30, 2017 The President signed an amending law on Tobacco Control which included provisions for plain packaging regulations, that must be implemented by January 1, 2018.

NEW ZEALAND—

  • September 14, 2016 Smoke-Free Environments (Tobacco Standardised Packaging) Amendment Act 2016 16 was given royal assent. A consultation ran from May to July 2016. 17 Detailed regulations are being finalized.

NORWAY—

  • December 9, 2016Parliament approved the bill to introduce plain packaging. 1819 The law comes into effect on July 1, 2017. Detailed regulations are pending. Law will apply only to cigarettes and hand-roll-tobacco.

ROMANIA—

  • October 12, 2016Parliament passed a lawthat implements the EU TPD and includes provisions that allow the Health Minister to introduce plain-packaging regulations. 20

SLOVENIA—

  • February 15, 2017Parliament passed a tobacco control bill 21, which implements the EU Tobacco Products Directive (TPD) and includes provisions for introducing uniform, no-brand packaging within two years.

THAILAND—

  • April 2, 2017 the Tobacco Product Control Act 2017 was gazetted which includes a provision (at Article 38) that allows the Minister to introduce regulations for plain packaging. 22 The law comes into effect on July 4, 2017.

 

Legislation being considered by Parliament

BRAZIL— Five different plain packaging bills have been introduced in the Senate and House of Representatives; the latest in May 2016 by Representative Rodrigues. 23

CHILE— Abill providing powers to introduce plain packaging was passed in the Senate in July 2015. 24 It has been assigned to the Health and Agriculture Commission in the House of Deputies but has since remained inactive, although pressure continues for it to be debated.

ECUADOR— A bill for plain packaging was introduced to the National Assembly on August 3, 2016, 25 which has subsequently been assigned to the health committee.

PANAMA— On January 2015, a bill was introduced to the National Assembly that would require plain packaging. 26 A sub-committee recommended it be removed making reference to the WTO TRIPS agreement, and no further action has since taken place.

Under formal government consideration

CANADA— The Liberal government had plain packaging as one of its manifesto commitments, and, in November 2015, it was set as a priority for the Health Department in a formal letter of mandate from the Prime Minister to the Health Minister. In May 2016, the government commenced a consultation 27 on detailed proposals for plain packaging, which ran until the end of August 2016.

FINLAND — The Government National Action Plan 28 included plain packaging as a planned measure in June 2014. Legislation was introduced in July 2016 to implement the EU TPD, which did not include plain packaging.

SINGAPORE— The Health Promotion Board commenced a public consultation on plain packaging from November 2015 to March 2016. 29 In March 2017, the Health Minister indicated an intention to move forward with the policy and that Singapore will hold a further consultation. 30

SWEDEN— The Minister of Health directed the committee examining the implementation of the EU TPD to also consider plain packaging. The committee report, 31 presented in March 2016, concluded that plain packaging would require a change to the Swedish constitution. The bill to implement the EU TPD was expected in 2016. It is not clear whether the bill will include plain packaging.

TAIWAN— On February 13, 2017, a draft Tobacco Hazards Prevention Act Amendment Bill was notified to the WTO (under TBT Article 2.9). 32 The draft includes a provision for uniform tobacco packaging.

URUGUAY—In November 2015, the President announced that the government was considering plain packaging. At a press conference on July 13, 2016, the Health Minister stated that plain packaging would be introduced in 2017 and that the law was being developed. 33

Political commitments given

BELGIUM— On April 9, 2016,the Public Health Minister announced that Belgium would have plain packaging by 2019.

BOTSWANA— On May 31, 2016, the Minister of Health announced that the government intended to introduce plain packaging laws.

KENYA— On May 31, 2016, the Cabinet Secretary for Health announced that a formal plan and timeline for implementation of plain packaging will be developed. On August 16, 2016, during the launch of thefirst Global Adult Tobacco Survey (GATS) in Kenya, the Cabinet Secretary for Health directed the Tobacco Control Unit to start the implementation of standardized packaging as part of the subsequent batch of graphic warnings.

MALAYSIA— In February 2016, the Health Ministry announced that Malaysia is planning to introduce generic packaging, though no firm dates were included in the announcement. However, on March 21, 2016, the Health Minister said no implementation date will be announced until talks with tobacco companies on intellectual property rights have concluded.

MAURITIUS— In September 2014,the Minister of Health made an announcement that it intended to include plain packaging in its National Action Plan for Tobacco Control (2014–2017). On June 6, 2016, the Health Minister renewed the government’s commitment to plain packaging.

SOUTH AFRICA— In July 2014, the Minister of Health announced that he wanted to introduce plain packaging and, in March 2015, he stated that legislation will be introduced. A further similar announcement was made in May 2016. Legislation providing enabling powers is in the process of being drafted.

THE GAMBIA— On August 3, 2016, the Minister of Health and Social Welfare stated that his Ministry is in full support of plain packaging and that The Gambia will soon join other countries that have already passed laws to implement plain packaging.

TURKEY— The Office of the Prime Minister published a decree on January 27, 2015, announcing the entry into force of the new National Tobacco Control Program and Plan of Action for 2015–2018, which includes plain packaging.

UNITED ARAB EMIRATES— In February 2014, the Ministry of Health announced that it intended to introduce legislation, which would include plain packaging, by 2016.

Other relevant laws

EUROPEAN UNION— Revised Tobacco Products Directive (TPD) adopted April 3, 2014 and came into force on May 20, 2016 and which introduces some elements of pack standardization and provides (at Article 24(2)) that the 28 EU Member States have the option of adopting further requirements to standardize tobacco packaging. 34
